Terms and Conditions of Sale

PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. THESE TERMS AND CONDITIONS GOVERN YOUR USE OF THIS SITE.

This Agreement and any documents referenced here contain all of the terms and conditions that apply to purchases by you (“Customer”) from Acushnet Company ("Titleist") sold by Titleist in the United States. By placing an order with Titleist, Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions are subject to change without prior written notice at any time, in Titleist's sole discretion.

Governing Law

THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. YOU MAY BE SUBJECT TO OTHER TERMS AND CONDITIONS GOVERNING CERTAIN FEATURES OF OUR SITE, INCLUDING PURCHASES FROM TITLEIST.

Payment Terms

Payment must be received by Titleist prior to Titleist's acceptance of an order. Payment for the products is to be made by credit card at time of order. Orders are not binding upon Titleist until accepted by Titleist. We reserve the right to refuse or decline any order whether or not the order has been confirmed and your credit card charged. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute our offer to sell. If your credit card has already been charged for the purchase and your order is declined, we will issue a credit to your credit card account in the amount of the charge.

Subscriptions and Recurring Payments 

In addition to the other terms herein, any subscription and recurring payment program (“Subscription”) in which you elect to enroll is subject to the following terms:

  1. Recurring Payments: You acknowledge that Subscriptions include a recurring transaction, and you authorize Acushnet Company to charge your provided payment method on a recurring basis according to the selected Subscription plan.
  2. Billing Frequency: You understand that your account will be automatically billed on a monthly basis for the amount indicated by the Subscription.
  3. Payment Method: The payment method provided by you during the Subscription signup process will be used for all recurring payments attributable to that Subscription. You are responsible for ensuring that your payment method information is and remains accurate and up-to-date.
  4. Review and Manage Subscription: You have the ability to review your subscription details, make changes to your subscription plan, update payment information, or cancel your subscription at any time by logging into your Titleist account on our website and visiting the “My Subscriptions” page, which can be found at www.titleist.com/my-subscriptions.
  5. Cancellation Policy: You may cancel your subscription at any time as indicated above. Cancellations will be effective at the end of the then-current subscription billing cycle, and refunds are not provided for partial subscription periods.

Shipping and Handling Charges

Separate charges for shipping and handling will be shown prior to order and on the invoice(s).

Taxes

Certain sales or other taxes may apply to your purchase. These taxes vary from state to state and will be collected for orders shipped to states where these taxes are applicable. The amount of tax charged is based on current state and local tax rates as well as other factors, including the identity of the seller, the type of item purchased, and the shipment destination of the order. Please review and confirm the taxes applied to your order in your shopping cart before submission.

Risk of Loss

Loss or damage that occurs during shipping by a carrier selected by Titleist is Titleist's responsibility.

Products

The Titleist product shown on www.titleist.com is an actual sample product of potential color combinations. Titleist is not responsible for variations of on-screen computer resolution and color calibration. This may result in a slightly different image of product on-screen versus end product delivered to Customer.

Acushnet Company reserves the right to reject orders for imprints on our products that may, in our sole discretion, be inconsistent with our company values or brand identity, including, but not limited to logos, designs and/or personalizations that are negative in nature, advocate violence or illegal activity, or are slurs, hateful, threatening, libelous, defamatory, vulgar, obscene or pornographic.

Scotty Cameron Limited Release Products

From time to time, Titleist may offer certain limited release Scotty Cameron putters and accessories for sale on or through the Site (“Scotty Cameron Limited Release Products”). Purchases of Scotty Cameron Limited Release Products are limited to one item per customer. Titleist reserves the right to cancel or otherwise restrict orders that exceed this limit. All sales of Scotty Cameron Limited Release Products are final.

Return Policy

Golf Balls
If you would like to submit a return for your Titleist.com golf balls, start a return using our self-service returns portal. Please note that we only allow returns for special edition golf balls or stock golf balls. Personalized and/or customized golf balls are not eligible for return. Return requests must be submitted within 30 days of product delivery. Only items eligible for return must be Only items in NEW and UNUSED condition are eligible for return. All return requests must be accompanied by the returns packing slip provided to you during the returns process.

All sales of personalized or custom products are final and may not be returned. If you purchased a personalized or customized product online and you would like to inquire about any inaccuracies, defects, or damage caused during shipping of the product, please contact our Customer Service team.

All returned items will be inspected for return eligibility in accordance with this Return Policy. Please allow a minimum of 10 days for us to receive and process your return. You will be notified via email once Titleist has processed the return. If your return is approved, you can expect a refund within 30 days of Titleist’s receipt of the returned product(s). Shipping and handling charges are not refundable.

Golf Clubs
If you would like to discuss returning your Titleist.com purchase of Titleist golf clubs, please contact our Customer Service team within 30 days of receipt of your package. Titleist will not accept returns of custom spec clubs or stamped wedges. All items eligible for return must be in NEW and UNUSED condition and must be accompanied by the original Packing Slip.

All returned items will be inspected for return eligibility in accordance with this Return Policy. Please allow a minimum of 10 days for us to receive and process your return. You will be notified via email once Titleist has processed the return. If your return is approved, you can expect a refund within 30 days of Titleist’s receipt of the returned product(s). Shipping and handling charges are not refundable.

Golf Gear
If you would like to submit a return for your Titleist.com golf gear purchase, start a return using our self-service returns portal. Return requests must be submitted within 30 days of product delivery.Only items in NEW, UNUSED, and UNALTERED condition, with all original labels and tags attached, are eligible for return. All return requests must be accompanied by the returns packing slip provided to you during the returns process. Shipping and handling charges are not refundable. Final sale items are not eligible for returns. All sales of personalized or custom products are final and may not be returned. If you purchased a personalized or customized product online and you would like to inquire about any inaccuracies, defects, or damage caused during shipping of the product, please contact our Customer Service team.

Scotty Cameron Limited Release Products
Titleist will only accept returns of Scotty Cameron Limited Release Products if they are defective or otherwise not in conformity with your order upon receipt. For inquiries about returning defective Scotty Cameron Limited Release Products, please contact customersupport@scottycameron.com.

Notwithstanding any provision above, Acushnet Company reserves the right to determine, in its sole discretion, abuses of this Return Policy with respect to any and all products subject to the Policy, and to deny returns accordingly.

Fitting Terms and Conditions

Fittings are available by appointment only. Please visit www.titleist.com/fitting/appointments to book your appointment today. If a fee for the fitting (a “Fee”) is being charged, customers will need a valid credit card in order to hold a reservation. Your credit card will be charged 100% of the Fee as a non-refundable deposit. If you purchase any club from your fitting on the same day as your fitting, the Fee will be applied to your purchase. Once the reservation has been booked, you will receive a confirmation email from our online booking system. If for any reason you need to cancel the fitting you will be charged the full Fee if you cancel within 24 hours of the appointment. If you need to reschedule the fitting, we ask that you do so at least 7 days before your appointment as a courtesy. You may reschedule your fitting one (1) time for no additional Fee. Limitation of Liability

Titleist will not be liable for any failure or delay in performance due in whole or in part to any cause beyond Titleist's reasonable control including, but not limited to, strikes, riots, wars, fires, terrorist acts, acts of God or acts of compliance with any law or regulation. In no event shall Titleist be liable to Customer for any (i) special, indirect, incidental or consequential damages, or (ii) damages resulting from loss of use or profit, unless required by law. New Jersey permits the limitation or exclusion of consequential damages unless unconscionable.

Errors

Titleist attempts to ensure that the information on the site is accurate, complete and current. However, despite our best efforts, there will be instances where information about an item contains inaccurate or incomplete data, including the data about the item's price or availability. We make no guarantee that the information on this site is error-free, complete or accurate.

In the event a Titleist product is listed at an incorrect price or with incorrect information due to a typographical error or other error in pricing or product information, we will attempt to correct the error where discovered. We reserve the right to revoke any stated offer for any reason and to correct any inaccuracies or omissions, including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order cancelled, we will issue a credit to your credit card in the amount of the charge, and shall not incur any additional liability for such cancellation.

Applicable Law; Not For Resale or Export

Customer agrees to comply with all applicable laws and regulations of the various states and of the United States. Customer agrees and represents that it is buying for its own use, and not for resale or export.
